1. Legal Notice

In accordance with Belgian legislation on transparency and electronic commerce (Book XII of the Belgian Code of Economic Law), the following information identifies the publisher and operator of this Site.

Nexxmedis is registered with the relevant Belgian authorities as required for the exercise of medical and paramedical activities. Practitioners presented on this Site are registered with the Ordre des Médecins / Orde van Artsen and hold the professional qualifications required by Belgian law to practise in their respective specialities. Specific registration numbers (INAMI/RIZIV) for individual practitioners are available upon request or on the relevant practitioner’s page.

2. Acceptance of these Terms

These Terms constitute a legally binding agreement between you (the “User” or “Visitor”) and Nexxmedis, regardless of whether you are a prospective patient, an existing patient, or simply a visitor browsing the Site for informational purposes.

Your use of the Site, including browsing its pages, submitting a contact form, subscribing to any newsletter, or following a link to book a consultation, constitutes full and unconditional acceptance of these Terms, as they stand at the time of your visit.

Nexxmedis reserves the right to modify, update or amend these Terms at any time, in particular to reflect changes in applicable law, in the services offered, or in the functioning of the Site. Any such modification will take effect as soon as it is published on this page. We therefore encourage Users to review these Terms periodically. Continued use of the Site after a modification has been published constitutes acceptance of the revised Terms.

If you do not agree to any modification, your only recourse is to discontinue use of the Site. These Terms do not apply retroactively to modify any medical treatment already provided, which remains governed separately by the applicable rules of medical practice and the specific agreement between practitioner and patient.

3. Purpose of the Website and Medical Disclaimer

3.1 Informational purpose

This Site has been created to present Nexxmedis, its medical and paramedical specialities, its team of practitioners, its medical equipment, and general information about the consultations and services offered. Its purpose is strictly informational and promotional. It is not, under any circumstance, a tool for remote diagnosis, remote treatment, or medical consultation.

3.2 No substitute for professional medical advice

None of the content published on this Site, whether text, images, descriptions of medical conditions, descriptions of consultation types, articles, or any other material, constitutes medical advice, a diagnosis, a prescription or a treatment recommendation applicable to any individual situation. Every patient’s medical situation is unique, and only an in-person (or, where applicable, teleconsultation) assessment by a qualified practitioner can result in a valid diagnosis or treatment plan.

Users must never delay seeking medical attention, disregard professional medical advice, or discontinue a prescribed treatment on the basis of information read on this Site.

3.3 Emergencies

This Site is not designed and must not be used to communicate urgent or emergency medical information. It does not offer any emergency response mechanism. Any User experiencing a medical emergency must immediately contact the emergency services (dial 112 in Belgium) or go to the nearest emergency department, rather than attempt to contact Nexxmedis through this Site.

3.4 Accuracy of medical and general content

Nexxmedis makes reasonable professional efforts to ensure that the medical information presented on the Site (descriptions of specialities, equipment, and procedures) is accurate and reflects current medical practice at the time of publication. However, medical knowledge, technology and best practices evolve continuously, and Nexxmedis cannot guarantee that all content remains exhaustive or up to date at every moment. Where discrepancies exist between the Site and the information provided directly by a practitioner during a consultation, the information given during the consultation prevails.

3.5 Relationship between Site content and doctor–patient relationship

Browsing this Site, submitting a contact form, or booking a consultation through the third-party platform referenced on the Site does not, by itself, establish a doctor–patient relationship. This relationship is formed only once an actual consultation takes place between the patient and the practitioner, under the professional and ethical rules governing the practice of medicine in Belgium.

4. Online Booking

4.1 Third-party booking platform

Appointment booking for consultations at Nexxmedis is made available through a third-party online booking platform (currently Doctena). This Site does not host its own booking engine; instead, it provides a link that redirects the User to that external platform.

4.2 Effect of the redirection

Once you click the booking link and are redirected, you leave the Nexxmedis Site and enter a service operated independently by the third-party provider. From that point on, your use of the booking service is governed exclusively by that provider’s own terms of use, privacy policy, cancellation policy and no-show policy, which you should read carefully before confirming any appointment.

4.3 Scope of Nexxmedis’s responsibility

Nexxmedis is not responsible for:

• the technical availability, functioning, security, or performance of the third-party booking platform;
• any error, delay, malfunction, double-booking or data-processing incident occurring on that platform;
• the enforcement of the third-party platform’s own cancellation, rescheduling or no-show rules.

Any complaint or query relating specifically to the operation of the booking platform itself should be addressed to that provider directly.

4.4 Clinic-specific booking policies

Independently of the third-party platform’s own rules, Nexxmedis may apply its own policies regarding punctuality, late arrival, cancellation notice periods, and consultation fees, which will be communicated to patients directly by the clinic (by phone, email, or during the booking process) and are not part of these Terms.

4.5 Confirmation and no responsibility for third-party content

The confirmation of an appointment via the third-party platform does not constitute an offer or contract made directly by Nexxmedis through this Site; it is a service facilitated by, and subject to, the third-party provider’s own system.

5. Intellectual Property

5.1 Ownership of content

All elements making up this Site, including, without limitation, its structure, graphic design, layout, text, articles, photographs of the clinic, photographs and descriptions of medical equipment, logos, icons, and any other visual or textual element, are the exclusive property of Nexxmedis, or are used with the express authorisation of their respective rightful owners (including equipment manufacturers such as GE and BTL, where their materials are referenced).

5.2 Protected rights

This content is protected under Belgian and international intellectual property law, including copyright, trademark law, and database rights where applicable.

The Nexxmedis name and logo may not be used, reproduced or associated with any other product or service without prior written authorisation.

5.3 Permitted use

Users are permitted to view the Site and its content for personal, non-commercial, informational purposes only. Users may share a link to a page of this Site (for example, on social media or by email) provided the content itself is not extracted, copied or reproduced independently of the Site.

5.4 Prohibited use

Except as expressly permitted above, any reproduction, representation, adaptation, translation, modification, distribution, or commercial exploitation of all or part of the content of this Site, by any means and on any medium, without the prior written consent of Nexxmedis, is strictly prohibited and may constitute an infringement subject to legal action under Belgian intellectual property law.

5.5 Third-party trademarks

References to third-party equipment, brands or trademarks (such as GE Voluson, Dysis, Emsella/BTL) are made for informational purposes to describe the technology used by the clinic. These trademarks remain the exclusive property of their respective owners, and their mention on this Site does not imply any partnership, sponsorship or endorsement beyond the factual use of that equipment by Nexxmedis.

6. Limitation of Liability

6.1 General standard of effort

Nexxmedis undertakes to make reasonable efforts to ensure that the information published on the Site is accurate, complete and updated. However, the Site is provided on an “as is” and “as available” basis, without any warranty of any kind, express or implied, as to its accuracy, completeness, reliability, or fitness for a particular purpose.

6.2 Exclusions of liability

To the fullest extent permitted by applicable Belgian law, Nexxmedis shall not be held liable for:

• any direct, indirect, incidental, or consequential damage resulting from access to, use of, or inability to use the Site;
• any decision made or action taken by a User on the basis of information found on the Site, including any decision to delay or forgo medical consultation;
• temporary or prolonged unavailability of the Site due to maintenance operations, technical failures, cyberattacks, or any cause beyond the reasonable control of Nexxmedis;
• errors, inaccuracies, or omissions in the content of the Site, notwithstanding the reasonable efforts described above;
• any damage resulting from the use of hyperlinks to third-party websites referenced on the Site, including the online booking platform;
• any loss or corruption of data transmitted through the contact form, newsletter subscription, or any other feature of the Site, except in cases of proven gross negligence or intentional misconduct by Nexxmedis.

6.3 No exclusion of mandatory liability

Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under Belgian law, including liability for death or personal injury caused by proven negligence, or liability arising specifically from the provision of medical care itself, which remains governed by the applicable rules on medical liability and professional insurance, entirely separate from the operation of this website.

6.4 Force majeure

Nexxmedis shall not be held liable for any failure or delay in the operation of the Site resulting from circumstances beyond its reasonable control, including but not limited to internet service interruptions, hosting provider failures, power outages, or acts of public authorities.

7. Links to Third-Party Websites

7.1 Outbound links

This Site may contain hyperlinks directing Users to third-party websites or online services, including but not limited to the online booking platform (Doctena), websites of medical equipment manufacturers (such as GE and BTL), social media platforms, or professional directories.

7.2 No control, no endorsement

These links are provided solely for the convenience of Users. Nexxmedis has no control over the content, privacy practices, terms of use, availability or security of these third-party websites, and their inclusion on this Site does not constitute an endorsement, approval, or guarantee by Nexxmedis of their content or services.

7.3 User responsibility

Users who choose to follow a link to a third-party website do so at their own discretion and risk, and are encouraged to review the applicable terms of use and privacy policy of that third-party site before providing any personal information or taking any action on it.

7.4 Inbound links

Any website wishing to establish a hyperlink to this Site must first request written authorisation from Nexxmedis, except where the link is a simple, direct link that does not imply any false affiliation, endorsement, or misrepresentation of the relationship between the two sites.

8. Personal Data and Cookies

8.1 Reference to the Privacy Policy

The collection and processing of personal data through this Site, including data submitted via the contact form, the newsletter subscription, or any analytics and cookies used on the Site, is described in detail in our separate [Privacy Policy], which complies with Regulation (EU) 2016/679 (the General Data Protection Regulation, “GDPR”) and applicable Belgian data protection legislation.

8.2 Relationship with these Terms

The Privacy Policy forms an integral part of the contractual relationship between the User and Nexxmedis regarding the use of this Site, and should be read together with these Terms. In the event of any conflict between these Terms and the Privacy Policy specifically regarding the processing of personal data, the Privacy Policy shall prevail.

8.3 Medical data

For the avoidance of doubt, any personal or health data shared directly with a practitioner in the context of an actual consultation (in person or via teleconsultation) is governed by the specific rules on medical confidentiality, patient rights, and the applicable legislation on patient data (including the Belgian law on patients’ rights), and not merely by the general Privacy Policy of this Site.

9. Modifications to the Site and Service Interruption

Nexxmedis reserves the right, at its sole discretion and without prior notice, to modify, suspend, or discontinue all or part of the Site, its content, or its functionalities, whether for maintenance, technical, legal, or commercial reasons. Nexxmedis shall not be liable to Users for any such modification, suspension, or discontinuation.

10. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable Belgian law, that provision shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect, to the maximum extent permitted by law.

11. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Belgium.

Any dispute relating to the use of this Site that cannot be resolved amicably shall fall under the exclusive jurisdiction of the courts of Brussels, Belgium, without prejudice to any mandatory rules of consumer protection that may grant the User the right to bring proceedings before the courts of their own place of residence.
