This Cookie Policy explains how Nexxmedis (“we”, “us”, “the Clinic”) uses cookies and similar technologies on the website [nexxmedis.be] (the “Site”), and describes your rights and choices regarding them. This Policy should be read together with our [Privacy Policy], which explains more broadly how we process personal data.

- Regulation (EU) 2016/679 (the General Data Protection Regulation, “GDPR”), in particular Article 6 on the lawfulness of processing and Articles 4(11) and 7 on the conditions for valid consent;
- Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector (the “ePrivacy Directive”), as amended by Directive 2009/136/EC;
- the Belgian Act of 13 June 2005 on electronic communications (Wet betreffende de elektronische communicatie / Loi relative aux communications électroniques), and in particular Article 129 of that Act, which transposes Article 5(3) of the ePrivacy Directive into Belgian law and requires prior, informed consent before storing or accessing information on a user’s device, subject to limited exceptions (notably for cookies strictly necessary to provide a service explicitly requested by the user);
- the Belgian Act of 30 July 2018 on the Protection of Natural Persons with Regard to the Processing of Personal Data, implementing the GDPR at national level;
- guidance published by the Belgian Data Protection Authority (Autorité de protection des données / Gegevensbeschermingsautoriteit, “APD/GBA”) on the use of cookies and similar tracking technologies.
1. What Are Cookies
A cookie is a small text file that a website stores on your computer, smartphone, or other device when you visit it. Cookies allow the Site to recognise your device, remember your preferences or actions over time, and collect statistical or technical information about your visit.
This Policy also covers similar technologies (such as pixels, tags, and local storage) that serve equivalent purposes and are subject to the same legal requirements as cookies under Article 129 of the Belgian Act of 13 June 2005.
2. Categories of Cookies We Use
2.1 Strictly necessary cookies
These cookies are essential for the Site to function and cannot be switched off. They are typically set only in response to actions you take, such as recording your cookie consent choices. Under Article 129, §1 of the Belgian Act of 13 June 2005 (transposing Article 5(3) of the ePrivacy Directive), these cookies fall within the exception for cookies “strictly necessary” to provide a service explicitly requested by the user, and therefore do not require your prior consent.

2.2 Analytics cookies

3. Legal Basis and Consent
3.1 The consent requirement
Under Article 129 of the Belgian Act of 13 June 2005 and Article 5(3) of the ePrivacy Directive, storing or accessing information on your device (including through cookies) is only permitted if you have given your free, specific, informed, and unambiguous consent, except where the cookie is strictly necessary to provide a service you explicitly requested.
3.2 How we obtain consent
When you first visit the Site, a cookie banner informs you of the categories of cookies used and allows you to:
- Accept all non-essential cookies;
- Reject all non-essential cookies;
- Customise your choices by category (analytics, marketing).
Analytics and marketing cookies are only activated on our servers and in your browser after you have given explicit, opt-in consent through this banner. No pre-ticked boxes are used, in line with the requirements confirmed by Belgian and European case law and APD/GBA guidance on valid consent.
3.3 Withdrawing or changing your consent
You can withdraw or modify your consent at any time by accessing the cookie preference centre, available via the link in the Site’s footer (“Cookie Settings” / “Gestion des cookies”). Withdrawing consent does not affect the lawfulness of any processing carried out before withdrawal.
3.4 Browser-level controls

5. Retention of Cookie Data
Each cookie is retained only for the duration indicated in the tables in Section 2, after which it expires automatically. Where processing is based on your consent, we also retain a record of your cookie consent choices (and the date on which you gave or withdrew consent) for as long as necessary to demonstrate compliance with our obligations under Article 129 of the Belgian Act of 13 June 2005 and the GDPR’s accountability principle (Article 5(2) GDPR).
6. Your Rights
In addition to your right to withdraw consent described in Section 3.3, where cookies involve the processing of personal data (such as an IP address or an online identifier), you retain all the rights described in our [Privacy Policy], including the rights of access, rectification, erasure, restriction, portability, and objection, and the right to lodge a complaint with the Belgian Data Protection Authority:
